After completing the Membership Termination Request Form, we’ll review your submission and someone from our team will endeavour to process your request at the earliest opportunity within 3 business days during regular business hours (Mon – Fri, 9:00 a.m. – 5:00 p.m.).

No membership termination requests are processed unless a Membership Termination Request Form is submitted.

All termination policies below are as per your Membership Agreement that you entered into with The Physique Consultants Ltd., which were:

1. Agreed to by you;
2. Electronically signed by you; and
3. Emailed to you at your challenge induction on your first day at TPC.

All policies below are non-negotiable. No exceptions.

We stick to our terms as outlined due to our programs having a limited number of participants and you have reserved one of the limited spots.

Please ensure that you receive an automated confirmation email receipt of your membership termination request from noreply@formstack.com after you submit your form by clicking ‘Submit Termination Request’.

If you don’t receive an automated confirmation email receipt of your termination request, you’ve submitted your Termination Request Form incorrectly.

You understand that in the unlikely event that you default on a direct debit payment and fail to remedy the default after notification by TPC during the termination period, that you have already authorised TPC as per your membership agreement to notify any debt collection agency of the default. In the event that debt collection proceedings are commenced, as referred to above, you will be liable for TPC’s legal fees and related costs.

Here are the termination scenarios according to our three membership types:

Membership Type 1: Initial Paid 28-Day Challenge Trial Membership Period
• €194 (or two payments of €97).

Membership Type 2: 24-Week Transformation Program
• €49 per week for a total of 24 additional weeks (24 payments of €49) following the initial paid 28-day challenge trial membership period.

Membership Type 3: 4-Week Rolling Agreement
• €49 per week following week 20 of the 24-week transformation program.

MEMBERSHIP TYPE 1: INITIAL PAID 28-DAY CHALLENGE TRIAL MEMBERSHIP PERIOD
Terminating Your 24-Week Transformation Program Auto-Direct Debit During Your Initial Paid 28-Day Challenge Trial Membership Period

1. Initial Paid 28-Day Challenge Trial Membership Period Definition

1.1 Defined as:
(i) Your first 28 consecutive calendar days at TPC.
(ii) Commencing from: Monday at 00:00 hrs.
(iii) Ending on: Sunday at 23:59 hrs 28 days (672 hours) later.

1.2 Monday being the Monday in which your challenge induction occurred.

1.3 The end date and time of Sunday at 23:59 hrs is still applicable if you commenced your first session on Wednesday due to any reason(s), including Public Holidays.

1.4 Continuity/Auto-Renewal
You may terminate your 24-week transformation program auto-direct debit at ANY TIME during your initial paid 28-day challenge trial membership period ONLY by EMAILING billing@thephysiqueconsultants.com ONLY.

1.5 No other communication (phone or verbal) is accepted.

1.6 If no auto-debit termination request email is received via email at billing@thephysiqueconsultants.com within your first 28 days, the auto-direct debit is contracted for 24 weeks at €49 per week (24 payments of €49).

1.7 Thereafter, the 24-week transformation program contract may not be terminated by you until the remaining 24-week period has elapsed unless due to Moving Permanent Residence or Medical Termination Exemptions which only require a 28 day (672 hours) written notice period of cancellation by emailing billing@thephysiqueconsultants.com only, i.e., a payment of a 4-week value (€196) of the weekly debited amount (€49) as a termination fee to terminate your membership if you can no longer utilise the TPC services and facilities.

MEMBERSHIP TYPE 2: 24-WEEK TRANSFORMATION PROGRAM MEMBERSHIP PERIOD
(Following The Initial Paid 28-Day Challenge Trial Membership Period)

2.1 Terminating The 24-Week Transformation Program Early
You’re still required to pay the weeks outstanding on your 24-week contract period. For example, if you signed up for the 24-week transformation program and you cancel at week 12, you must pay out 12 weeks.

2.2 Terminating At Week 21, 22, 23 Or 24 Of The 24-Week Transformation Program
You’re required to give a minimum of 28 days (672 hours) of written notice for cancellation, i.e., a payment of a 4-week value (€196) of the weekly debited amount (€49) as a cancellation fee.

2.3 Medical Termination Exemption
You may cancel your TPC membership with a minimum of 28 days (672 hours) of written notice for cancellation, i.e., a payment of a 4-week value (€196) of the weekly debited amount (€49) as a cancellation fee if you can no longer utilise the TPC services or facilities due to:

(i) Permanent illness; and/or
(ii) Permanent physical incapacity.

You must provide a medical certificate advising the exact nature of the permanent illness or permanent physical incapacity outlining specifically how this prevents you from 
utilising the TPC services or facilities.

If applicable, this payment of a 4-week value (€196) of the weekly debited amount (€49) as a cancellation fee can be used as membership credit when you can recommence 
utilising the TPC services or facilities.

2.4 Moving Permanent Residence Termination Exemption
You may cancel your TPC membership with a minimum of 28 days (672 hours) of written notice for cancellation, i.e., a payment of a 4-week value (€196) of the weekly debited amount (€49) as a cancellation fee if you can no longer utilise the TPC services or facilities due to:

(i) Permanently moving residence and your new residence is more than 25 kilometres from the TPC Gym, provided that you resided within 25 kilometres of the TPC Gym at the time you commenced your agreement.

You must provide a legitimate verification of your permanent move of residence using an official document to prove change of address.

Official documents to prove your change of address include, but are not limited to, the following:

(i) Lease agreement with your name, commencement date and end date of the lease term specified; or
(ii) Utility bill with your name and date issued specified.

Note: all payments up to the date of moving and a minimum of 28 days (672 hours) of written notice for cancellation, i.e., a payment of a 4-week value (€196) of the weekly debited amount (€49) as a cancellation fee is required.

MEMBERSHIP TYPE 3: 4-WEEK ROLLING AGREEMENT MEMBERSHIP PERIOD
(Following Week 20 Of The 24-Week Transformation Program Membership Period)
You’re required to give a minimum of 28 days (672 hours) of written notice for cancellation, i.e., a payment of a 4-week value (€196) of the weekly debited amount (€49) as a cancellation fee.

Termination Request Deemed By The TPC Membership Team To Be Outside The Scope Of All Of The Above Aforementioned Terms
Any membership termination request deemed only by the TPC membership team to be outside the scope of all of the above aforementioned terms still requires a minimum of 28 days (672 hours) of written notice for cancellation, i.e., a payment of a 4-week value (€196) of the weekly debited amount (€49) as a cancellation fee.
